The petitioner is the defendant no.1 in Title suit No.166 of 2016 pending before the learned Civil Judge (Senior Division), 7th Court at Alipore, District 24 Parganas (South).

It is the contention of the petitioner that the suit has been dragging for a long time and the petitioner is suffering an order of status quo. It is also submitted that the application for injunction has not yet been disposed of and the order of status quo has been extended from time to time, which has caused serious prejudice to the defendant/petitioner.

Without going into the merits of the case of the petitioner and without making any observations on the dispute involved in the suit, the revisional application is disposed of with a direction upon the learned court below to dispose of Title Suit No.166 of 2016 along with all pending applications as expeditiously as possible, preferably within a period of one year from the next date fixed.

The learned court below will proceed independently and in accordance with law without being influenced by any observations made hereinabove.

The petitioner is directed to serve a copy of this revisional application along with a server copy of this order upon the opposite party no.3 within a week from date. The revisional application is disposed of.

There will be, however, no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
