For the alleged contemnor/respondent It is submitted on behalf of the alleged contemnor/respondent that the order dated 14th October, 2004 passed in WP 17206 (W) of 2004 is the subject matter of the contempt petition. The said order directed the Director of School Education (Primary Education) to consider the panel at the earliest so that appointment can be issued to the selected candidates after grant of approval to the said panel. According to the alleged contemnor, the case as directed by the order dated 14th October, 2004 has been duly considered. Referring to a memo dated 21st March, 2013 issued on behalf of the Commissioner of School Education, West Bengal, it is submitted that the order dated 14th October, 2004 has been complied with, though at a belated stage. It is further submitted by the alleged contemnor that since the exercise required involvement of several departments, it

took a considerable period of time and there was no intentional delay.

Although complying with an order passed on 14th October, 2004 sometimes around 21st March, 2013 does not speak of early consideration as directed by the said order dated 14th October, 2004, yet the delay is condoned and compliance of the order is accepted. The documents handed over by the learned advocate for the alleged contemnor are taken on record.

The contempt proceedings are dropped. The contempt petition is disposed of without any further order by recording compliance of the order, being the subject matter of the contempt petition.

Rule stands discharged accordingly.
