Asaduzzaman Biswas v. State Of West Bengal And ORS.
06.02.2024 Item No.10 Court No.18 AJ.
W.P.A. 336 of 2024 Asaduzzaman Biswas -Vs- The State of West Bengal & Ors.
Mr. Anjan Bhattacharya.
.....for the petitioner.
Ms. Tapati Samanta.
....for the State.
Mr. Sunit Kumar Ray.
....for the WBCSSC.
Affidavit of service filed on behalf of the petitioner be kept with the record.
The petitioner is an Assistant teacher in the subject Bengali at Shakuntala High School (H.S.), District : Uttar Dinajpur, he had applied for general transfer through 'Utshasree Portal' on the grounds that the distance between his residence and the school is 300 km, as such he is unable to look after his aged parents and minor daughter . The school refused to grant 'No-Objection' to the said prayer of the petitioner on the ground that he is not coming within 10% of the teaching staff of the school. Mr. Bhattacharya strenuously argues that the said refusal of the school is not sustainable.
Be that as it may, the 'Utshasree Portal' portal is now under suspension, therefore the prayer of the petitioner for general transfer cannot be considered at this stage. WPA 336 of 2024 is therefore dismissed without any order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
