Learned Counsel for the petitioner has submitted that the petitioner is in custody for about one year and six months.

Another co-accused person similarly circumstanced as this petitioner has been granted bail. As such, the present petitioner may be enlarged on bail on any condition.

Learned Counsel for the State opposes the prayer for bail. According to her, there are sufficient incriminating materials against this petitioner. On July 5, 2024, the bail prayer of the petitioner was rejected on the ground that there was some recovery from his possession.

Learned Counsel for the State has also pointed out that several dates have been adjourned due to the defence and as a result of which charge could not be framed. 4.

We have considered the materials on record and CD. There are sufficient incriminating materials against the present petitioner. Certain live ammunitions along with other incriminating materials have been recovered from the possession of the petitioner. The records show that delay, if any, has been caused due to the defence. 5.

In view of the aforesaid, we are not inclined to allow the petitioner's prayer for bail, at this stage.

The prayer for bail is rejected.

CRM (DB) 139 of 2025 stands dismissed.
