Petitioner-in-person would submit that there are formal defects in the writ petition as such, he seeks leave to withdraw the same with a liberty to file afresh on the self-same cause of action.

Mr. Mitra, learned senior advocate representing the respondent no. 8 would submit that petitioner has not identified any formal defect and as such no leave ought to be granted.

Having heard the learned advocates for the respective parties and considering the fact that the petitioner seeks to withdraw the petition with liberty to

file afresh, I am of the view that the writ petition be dismissed as withdrawn. The petitioner, however, shall be at liberty to file afresh on the self-same cause of action though the maintainability thereof is kept open to be decided at such time as and when such application is taken up for consideration, if at all.
