This contempt application has been filed alleging willful disobedience of the order dated 22nd February, 2024 in W.P.A. (P) 58 of 2024.

The writ petition was disposed of without going into the merits of the matter by issuing the following direction:- "5. In the light of the disputed questions of fact, we would direct the respondent no. 13 viz. the Block Land and Land Reforms Officer to inquire into the matter and after conducting the joint inspection with the officials of the Forest Department with notice to the respondent no. 17 and based on such inspection, the competent authority is directed to proceed in accordance with law.

6. The inspection shall be conducted within a period of two weeks from the date of receipt of server copy of this order and thereafter the matter shall be taken to the logical end."

A draft affidavit to be filed by the District Magistrate and Collector, Paschim Bardhaman has been produced, from which it is seen that inspection has been conducted and the officer has stated that immediate compliance of the order has been taken. 4.

Let the District Magistrate and Collector, Paschim Bardhaman pass an order with regard to the action taken by the Forest Department in the District pursuant to the direction issued in the writ petition and communicate the same to the contempt applicant within a period of two weeks from the date of receipt of server copy of this order.

If still the applicant is aggrieved, it will be well-open to the applicant to avail remedies in accordance with law. 6.

With the above observation, contempt application stands disposed of.

Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
