Purbasthali - I started a Misc. Case against the petitioner bearing Misc.

Case No.

1634/212(1038)/21 and passed a final order in order to dispose of the said Misc. Case. The petitioner filed an application dated 29.09.2023 along with requisite court fee for obtaining a certified copy of such order of the said Misc. Case. In spite of the said representation the B.L. & L.R.O. Purbasthali - I failed to perform their statutory obligations till date without assigning any cogent ground.

The petitioner has preferred the present writ petition seeking a certified copy of such order of the said Misc. Case No. 1634/212(1038)/21.

Learned counsel for the respondent had appeared on advance notice and has handed over the status report stating that the proceedings are still ongoing.

Learned counsel for the respondent states that the writ petition is premature hence no orders have passed and no certified copy of the same can be provided at this stage because the proceedings are still in process.

In view of the aforesaid, since the writ petition is premature in nature, it is hereby dismissed. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
