Learned advocate appearing for the petitioner submits that petitioner was implicated and detained in connection with the instant case for alleged recovery of 50 bottles of phensedyl from his possession. Petitioner is in custody for nine months and charges have already been framed and dates have been fixed for evidence. Learned advocate for the State opposes the prayer for bail and submits that the prosecution intends to examine 13 witnesses in support of its case.
Having considered the subject matter of the case, I am of the view that although a case has been made out but in spite of the same petitioner being in custody for nine months and charges having been framed only and there is no possibility of trial being concluding in near future, I am inclined to release the petitioner on bail on stringent conditions. Accordingly, the prayer for bail of the petitioner is allowed.
As such, petitioner namely, Rajesh Sk @ Laden shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional District and Sessions Judge, 4th Court cum Special Court under NDPS Act, Alipore, South 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case and shall not leave the jurisdiction of district of South 24 Parganas without the prior permission of the learned Special Court. The petitioner shall meet with the investigating officer or any officer deputed by the Inspector-in-Charge or Officer-in-Charge of Bishnupur Police Station once in a week till it is modified by the learned trial Court.
Accordingly, the application for bail being CRM (NDPS) No. 56 of 2026 is allowed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
