1. Affidavit of service filed in Court today is taken on record.

2. The petitioner has filed an objection to the grant of license for sale of foreign liquor in favour of the private respondent. The same is yet to be considered.

3. Learned counsel representing the respondent authority submits that the application for the retail excise license for sale of foreign liquor is at the stage of enquiry. No decision has yet been taken in connection with the said application.

4. In view of the above, the instant writ petition is disposed of by directing the Collector of Excise to take a decision on the application made by the private respondent only upon affording an

opportunity of hearing to the objectors in accordance with law at the earliest.

5. The instruction forwarded by the department be retained with the records.

6. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
