Mr. Arijit Ganguly ......For the State The report, called for previously, by order dated 8th January, 2021 is produced, and let it be kept on record. Mr. Arijit Ganguly, learned advocate represents the State. It appears from the report that chemical examiner's report has already been collected following which supplementary charge sheet has been submitted on 30th September, 2020. Learned advocate Mr. S. G. Chowdhury represents the petitioner and submits that the petitioner is languishing in custody since 24th February, 2020 for the alleged recovery of 20.3 kgs. of ganja.
Upon perusal of the xerox certified copy of the order of the learned court below, it appears that date has already been fixed for consideration of the charge. It could be revealed in course of hearing that the next date is fixed on 23rd February, 2021 for consideration of charge. That being the position, the case may
be disposed of giving following directions bearing in mind the effect of pandemic surfacing the entire country. Learned trial Judge of N. D. P. S. case no.11 of 2020, being learned Additional Sessions Judge Cum Judge Special Court, Hooghly, (N. D. P. S. Court) is directed to consider the charge on the next date so fixed, and if for any reasons whatsoever, the same could not be done, frame the charge within three (03) weeks thereafter. It is further ordered that after framing of charge, dates may be scheduled for collection of the evidence aiming at ensuring expeditious disposal of the pending case taking sincerest support from the learned Public Prosecutor so that the date, so scheduled, for collection of the evidence may be effectively utilized for protecting the personal liberty of the custody accused.
With these directions and observations, the revisional application is disposed of.
