Affidavit-of-service is taken on record. Despite service, none appears on behalf of the respondent No.7. The petitioner alleges disturbance in the enjoyment of his own property, by the respondent No.7. The allegation is that the police authorities of Talpatighat Coastal Police Station, failed and neglected to take steps on the basis of the complaint filed by the petitioner.
The police report is taken on record. It appears that, on the basis of the complaint lodged by the petitioner through post, the police authorities submitted a requisition before the Block Land and Land Reforms Officer, Khejuri-II with a request to provide the data regarding Plot Nos.45 and 46 of mouza Chakarokhari, Khejuri-II. The matter was enquired into and prosecution under Section 107 of the Code of Criminal Procedure, was submitted against the respondent
No.7. Again on March 29, 2022, the petitioner filed a complaint and Talpatighat Coastal Police Station Case No.26 of dated March 29, under Sections 447/341/427/379/506/34 of the Indian Penal Code, had been registered. The case is under investigation.
Under such circumstances, the police authorities shall conclude the investigation in a free, fair and impartial manner and take necessary steps as per law. The police will maintain peace.
This order shall not be construed as an acceptance of the allegation made against the respondent No.7. The merits of such allegations are within the domain of the investigating agency.
The writ petition is, thus, disposed of.
There will be no order as to costs.
All parties are to act on the basis of the server copy of this order.
