1. Learned advocate for the applicant/writ petitioner after some arguments submits that the substantial issue in the present writ petition is arising out of the O.A. No. 634 of 2016 filed before the West Bengal Administrative Tribunal. It is his case that he was regularized on 18.04.1996 whereas he has been considered as having been appointed on 01.05.1997. The date of appointment is mentioned as such in the pension payment order issued on 03.04.2018.

2. He submits that the result of such erroneous consideration has adverse rippling effect on his pensionary dues. He wants to approach the authorities for correction of such alleged error.

3. Without expressing any opinion on the merits of the above noted submissions, having regard to the prayer made by the learned advocate, we permit him to approach the authorities. Therefore, nothing survives in the present Writ Petition and the pending Original Application (O.A. No. 634 of 2016).

4. The Writ Petition and the Original Application (O.A. No. 634 of 2016) are disposed of with such liberty.

5. We make it clear that we have not expressed any opinion on the merits of the petitioner's claim.

6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
