Criminal Revisional Jurisdiction CRR 50 of 2021 21-09-2022 Subha Item no.38 Pravin Kumar Tiwari -versus- Ajit Chandra Mandal & Anr.

The present revisional application has been preferred for expeditious Ct no.34 disposal of Complaint Case No. 3447 of 2017 pending before the learned Judicial Magistrate, 10th Court, Alipore, South 24 parganas in connection with a proceeding under Section 138 of the N. I Act.

In view of the court operating in a staggered manner for a substantial period of time, neither the proceedings could progress nor the courts are in a position to adjudicate all the cases. However, the petitioner is aggrieved because of the complaint case filed in the year 2017.

Having regard to the nature of the prayers so advanced by the petitioner, I direct that the learned Judicial Magistrate, 10th Court, Alipore would adhere to the statutory mandate of the N. I. Act. The learned court would be at liberty to pray for fixing at least one date in a month for the purposes of Complaint Case No. 3447 of 2017 so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations, the revisional application being CRR 50 of 2021 is disposed of.

Pending applications, if any, are consequently disposed of. Interim order, if any, is hereby vacated.
