This is an application for expeditious disposal of G.R. case No. 4864 of 2017 arising out of Dum Dum Police Station Case No. 745 of 2017 dated 26th July, 2017 under Sections 498A/ 406/ 506 of the Indian Penal Code presently pending before the learned Additional Chief Judicial Magistrate, Barrackpore.

On perusal of the averment made in the instant revision and having heard the learned Advocate for the petitioners this Court is of the view that the instant revision can be disposed of here and now with the assistance of the learned Advocate for the State. Accordingly, Mr. Sk. Arif
Hossain learned Advocate is requested to assist this Court on behalf of the state. Appointment of Mr. Sk. Arif Hossain learned advocate be regularized by the learned Legal Remembrancer, Government of West Bengal.

It is submitted by the learned advocate for the petitioner that the case was initiated on the basis of a written complaint made by one Paromita Dasgupta being the wife of petitioner no. 1 herein before the Dum Dum Police Station on 26th July, 2017 alleging, inter alia, that after their marriage on 17th February, 2016 she was subjected to mental torture. On 8th April, 2017 she was driven out of her matrimonial home and her stree-dhan properties were not returned. On 19th May, 2017 she gave birth to a male child and later she came to know that the petitioners forged her signature in her photocopy of identity proof and collected the child's birth certificate from the municipality. The petitioners on 31st July, 2017 surrendered before the Learned Additional Chief Judicial Magistrate at Barrackpore and got regular bail.
After completion of investigation chargesheet was filed on 30th August, 2017 and charge was framed on 5th April, 2019 under section 498A/ 406/ 506 of the IPC against the petitioners but could not be framed against another accused namely Jayanti Dasgupta being bed ridden and non-appearance before the court. Examination in chief of the complainant was concluded on 18th January, 2020, since then trial could not be proceeded due to Covid pandemic. The matter lastly appeared on 14th July, 2021 fixing next date on 16th November, 2021 but the case has not been proceeded till date.

Under such circumstances, petitioners have prayed for expeditious disposal of the case.

In view of such circumstances, the instant revision is disposed of directing the trial court to conclude the trial within June, 2023 and dispose of the above mentioned case as expeditiously as possible within July 2023.
