Learned advocate appearing for the petitioner is aggrieved by the fact that NDPS Case No. 20 of 2016 is pending for the last seven years before the learned Judge, Bench-I, City Sessions Court, Calcutta and till date only two witnesses have been examined. Learned advocate submits that there are ten witnesses to be examined, but because of non-appearance of the witnesses concerned and no efforts being taken by the prosecution, unnecessarily the trial of the case is dragged.

Having regard to the time period which has elapsed, I direct that the learned trial court henceforth will fix a schedule consisting of three dates once in every sixty days so that trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment be granted to any of the parties. In case any witness is absent, the Officer-in-Charge, Narcotic Cell, D.D., Lalbazar should be directed to take steps for executing summons.

Learned public prosecutor conducting the case would ensure regarding the production of materials, documents and exhibits on the dates so fixed for examination of the witnesses.

All stakeholders would cooperate with the learned trial court to conclude the trial at the earliest.

With the aforesaid observations, the revisional application being CRR 62 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
