By consent of the parties, this matter is taken up for hearing out of turn.

During the pendency of the appeal, good sense prevail amongst the parties, who are brothers and sister. They have come forward with a prayer for compromise by way of terms of settlement signed by the parties and their respective learned advocate on record. It is prayed on behalf of the parties for disposal of the appeal on the basis of the settlement arrived at between the parties. The terms of settlement filed by the parties is taken on record. The parties are present before us.

We have perused the terms of settlement. In view of the fact that the parties have entered into an agreement expressing their willingness to settle the disputes amongst themselves on the terms reduced in writing in conformity with Order XXIII Rule 3 of the

Code of Civil Procedure, by mutual consent of the parties, the appeal is disposed of on the basis of the terms of settlement arrived at between the parties.

Let the terms of settlement along with the sketch map do form a part of the decree.

There will be no order as to costs.
