Aptabuddin .... for the petitioners Mr. Srijan Nayak, Mrs. Rituparna Maitra .... for the State The petitioner, one of the members of the Vivekananda Samabay Abasan Samity Limited, submits that the respondent no.3, that is, the Registrar of Co-operative Societies, Government of West Bengal is not complying with the order of the Deputy Registrar of Co-operative Societies dated March 6, 2020.

It is further contended that subsequent to the order dated March 6, 2020, annexed at page-20 (Annexure - P-1) to the present writ petition, several complaints have been lodged which have direct bearing on the said order.

Upon hearing learned counsel for the parties and going through the materials on record, it is

evident that an inquiry in respect of the Vivekananda Samabay Abasan Samity Limited was directed by the Deputy Registrar of Co-operative Societies vide order dated March 6, 2020 (Annexure - P-1 at page-20 of the writ petition).

Hence, it is the incumbent duty of the respondent-authorities to ensure that such inquiry is undertaken and, upon taking adequate notice of and considering the complaints filed in connection with such inquiry subsequently, including the complaint dated December 15, 2021, is concluded expeditiously. Accordingly, WPA No.347 of 2022 is disposed of by directing the respondent-authorities to ensure that the inquiry, as contemplated in the order of the Deputy Registrar vide Memo No.265 dated March 6, 2020 (Annexure - P-1 at page-20 of the writ petition), be held as expeditiously as possible, in accordance with law, positively within June 30, 2022.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
