Report filed by the State is taken on record. Learned Advocate appearing for the petitioner submits that other than the statement of a co-accused, there are no incriminating materials available against the petitioner. Learned Advocate appearing on behalf of the State relies on the report and the case diary and opposes the prayer for anticipatory bail. He submits that other than the statement of the co-accused, there are phone call records regarding frequent calls made between the petitioner and the principal accused including on the day of the crime.

Considering the above, the other incriminating materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I am not inclined to grant anticipatory bail to the petitioner.

The application for anticipatory bail is, thus, dismissed. ( Jay Sengupta, J. )
