The petitioner's application for transfer was declined on the ground that he was hit by 10% Rule. It now appears that one Raj Kumar Ghosh, whose application was also pending along with the petitioner has been transferred.
The petitioner is, therefore, not hit by the 10% Rules.
In that view of the matter, the head of the institution shall forward the petitioner's application for transfer to the District Inspector of Schools (SE), Uttar
Dinajpur, who shall consider the same strictly in terms of 2015 Rules as amended from time to time. Consideration of the petitioner's application shall be made within a period of six weeks from date. The School shall forward the application of the petitioner for transfer by tomorrow.
The order returning the petitioner's application for transfer by the head of the institution shall stand set aside.
With the aforesaid observations, the instant writ petitioner shall stand disposed of.
There will be no order as to costs.
