1. Pursuant to the order dated 9th March, 2026, the municipality has filed a report. It would reveal from the report that an inspection has been carried out by the municipal authorities on 16th March, 2026 at 02:30 p.m. at premises No.8, Ainuddin Ghat Majhi Lane, Ward No.18, Post Office & Police Station & District - Howrah, Pin - 711 101.

2. The report would reveal that the building in question has been constructed in the year 1983 and was sanctioned up to G+3 storied. Later, a construction was made up to G+4 and partly up to G+5.

3. Such construction has also been regularized upon payment of retention fees. The ownership of the building has also been transferred in favour of the

present owner, namely, Rita Paul. The report does not disclose whether the building is dangerous or is dilapidated. Accordingly, this Court is of the view that there is no scope to retain such frivolous petition in the file.

4. Considering the above and noting that the present petitioner has approached this Court alleging that the adjacent building owned by the private respondent is dilapidated and is tilting towards the petitioner's residence and in support thereof had placed reliance on a document dated 1st September, 1990, I am of the view in the given facts that there is no scope to retain such petition in the file.

5. The writ petition is, accordingly, dismissed. There will be no order as to costs.

6. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
