Petitioner's main contentions in the information furnished to the police authorities are that they are being attempted to be dispossessed from their land and their crops are being taken away by the private respondents on the plea that they are Bargadars.

In spite of informing the police authorities no action has been taken.

Learned advocate for the State has submitted a report. Report reflects that a General Diary Entry being GDE No. 1709 dated 30.11.2024 has been registered and subsequently proceedings have been drawn up under section 126/135(3) of the BNSS as it was found that the respondents have used filthy

languages towards the complaint and were creating nuisance.

Be that as it may, since the Superintendent of Police directed the Officer-in-Charge, Kultali Police Station to ensure that both the parties are to maintain peace and tranquility, I direct that the Inspector-in-Charge of Kultali Police Station would give effect to the tenor and spirit of the directions of the Superintendent of Police of Baruipur Police District.

Learned advocate for the private respondents submits that a title suit is pending between the parties and unnecessarily the private respondents are being harassed as they are poor person.

In view of the strained relationship existing between the parties, police authorities would ensure that there is no breach of the peace and/or tranquility at the locale and no untoward incident results because of such strained relationship. Effective measures should be taken by the police authorities so that because of the act and activities of the parties, the situation is not blown out of control.

With the aforesaid observations WPA 528 of 2005 is disposed of.

Report so submitted be kept with the record.

Copy of the report be handed over to both the parties.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
