Mr. Mobaidur Hossain ... for the petitioner Petitioner herein has prayed for expeditious disposal of GR Case No. 2005 of 2020 presently pending before learned Chief Judicial Magistrate, First Class 2nd Court, Tamluk, Purba Medinipur.

Learned counsel for the petitioner submits that in this case charge-sheet was submitted on 26th August, 2021 thereafter charge was framed on 6th January, 2023 but till date not a single witness has been examined and the prosecution has proposes to examine eleven witnesses.

Petitioner being the defacto complainant is suffering a lot due to long pendency of the matter. Therefore, petitioner has prayed for a direction upon the court below for expeditious disposal of the aforesaid proceeding. Having heard learned counsel for the petitioner, and that the prayer made by the petitioner is innocuous and, if it is allowed in terms of the prayer made in the petition, the opposite parties will have no cause to prejudice and as such, service of copy of application upon the opposite parties is dispensed with. It appears from the submission of the petitioner that cognizance was taken by the court below on 27.08.2021 and charge was framed on 06.01.2023 and thereafter on 08.11.2023, 02.12.2023,10.05.2024,29.07.2024,22.10.2024,01.02.2025,26.06

.2025 and 25.12.2025 were fixed for evidence but no evidence has been recorded so far. It is alleged by the petitioner that all the accused persons are on bail and five years have already been expired but recording of evidence has not yet been commenced. Therefore the prayer made on behalf of the petitioner is justified, and required to be allowed for the ends of justice. In view of the above, the instant application being CRR 116 of 2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the aforesaid GR Case No. 2005 of 2020 presently pending before learned Chief Judicial Magistrate, First Class 2nd Court, Tamluk, Purba Medinipur, and to make his best effort to conclude the trial preferably within a period of six months from the next date of hearing without granting any unnecessary adjournment to either of the parties.
