Learned advocate appearing on behalf of the petitioner submits that petitioner has been falsely implicated in connection with the instant case for alleged recovery of 501 Kgs. of Ganja from two vehicles. Learned Advocate for the petitioner submits that the petitioner is in custody for about two years and no witness action till date has commenced. Learned Advocate appearing for the State opposes the prayer for bail and submits that all efforts have been put in by the prosecution to commence witness action.

Having considered the submissions of the respective parties, I direct the learned Trial Court that on and from the

next date, at least within a period of six months, examine six witnesses including the seizure list witnesses. Petitioner would be at liberty to approach this Court after the aforesaid period is over.

Learned Advocate for the State would communicate this order to the learned Special Court through the Public Prosecutor conducting the Trial.

However, at this stage C.R.M. (NDPS) No 69 of 2026 is dismissed.

All concerned parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
