No. 29 CHC REJECTED C.R.M.(A) 75 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Islampur Police Station Case No. 378 of 2018 dated 04.07.2018 under Sections 21(c), 23(c) of Narcotric Drugs and Psychotropic Substances, Act, 1985.

And In Re : Dhola alias Basir ...... petitioner Mr. Kushal Paul ....for the petitioner Mr. T. D. Nandy, Mr. Antariksha Basu ....for the State Police case was registered on July 4, 2018.

Considering the long absconsion of the petitioner in respect of such police case and considering the materials in the case diary, we are of the view that petitioner is unable to overcome the restriction under Section 37 of the N.D.P.S. Act, 1985. Consequently, we unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 75 of 2023 is dismissed.
