The petitioner is aggrieved by the act on the part of the West Bengal State Electricity Distribution Company Limited in not issuing the contract in its favour despite being found as the lowest bidder.

The terms and conditions stipulated in the notice inviting tender (p.15) clearly mentions that the agency shall possess at least three years of minimum experience of working in Ganga Sagar Mela and that the experience certificate must be submitted along with the quotation.

The petitioner is unable to produce any document to show that it has three years' experience of working in Ganga Sagar Mela. On the face of the documents placed before this court, it is evident that the petitioner does not satisfy the eligibility criteria for participation in the subject tender. The authority has rightly declined to accept the bid of the petitioner.

Hence, the writ petition being devoid of any merit

fails and is hereby dismissed.
