Learned counsel for the petitioner submits that the petitioner was appointed as 'anganwadi' worker at Lakhanpur Gram Panchayat on 5th February, 2008. A criminal case was registered against her on 21st October, 2011 for which she suffered custody. However, she was acquitted from the charges on 20th December, 2022. The petitioner resumed service on 4th August, 2021 pursuant to the direction of the Child Development Project Officer, Hura ICDS Project, being the 4th respondent herein. The petitioner seeks arrear salary for the period of her absence from the job as well as regularization of her appointment. On prayer of the petitioner, liberty is granted to submit a comprehensive representation in this regard before the 4th respondent within a week from date. The 4th respondent is directed to consider and dispose of the same within four weeks from the date of receipt thereof upon

affording reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. In the event the 4th respondent arrives at a decision in favour of the petitioner, necessary consequential steps be taken at the earliest.

The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
