And In Re : Bappaditya Biswas Petitioner Mr. Sourav Chatterjee Mr.Soham De Dhara For the Petitioner Mr. Bivash Chatterjee For the State Apprehending arrest in connection with Bidhannagar Cyber Crime Police Station Case No. 60 of 2020 dated 30.07.2020 under sections 419/420/468/469/471/120B of the Indian Penal Code, the petitioner has filed the present application. The learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and he has been victimized by the bank and finally he has been terminated from the services. As the nature of allegations relate to cyber crime offences, none of the sections have been incorporated while submitting the charge sheet and the petitioner has been roped in.

Additionally, the learned advocate submits that the petitioner undertakes to abide by any condition imposed by this Court if the privilege of anticipatory bail is granted to him. The learned advocate appearing for the State opposes the prayer for bail and draws the attention of this Court to the incriminating materials in the case diary appearing against the petitioner.

We have taken into account the nature of allegations and gravity of the offence and the incriminating materials appearing against the present petitioner. On assessment of the same, we are of the opinion that the petitioner is not entitled to the privilege of anticipatory bail and as such the prayer for anticipatory bail of the petitioner is rejected. The application for anticipatory bail, being CRM No. 226 of 2021, is dismissed.
