He submits in fairness that impugned order dated 3rd September, 2016 dealt with his client's application made under Order 9 Rule 4 , Code of Civil Procedure. It is revisable but not appealable.

We find the appeal is not maintainable. As such, we dismiss the appeal and connected application with liberty to appellant to file for revision, if so advised, taking the necessary plea of exclusion. Certified copy of impugned order may be returned to the learned advocate upon furnishing a true copy thereof.

Photostat certified copy of this order be made available to the learned advocate on requisition duly put in.
