The present application under Section 439 of the code of Criminal Procedure has been preferred by the petitioner in connection with S.T. 3(2)2019 and (S.C. 33/2019) arising out of Dutta Pukur P.S. Case No. 664/18 dated 01.08.2018 under Section 302 of the Indian Penal Code read with Sections 25/27 Arms Act.

The learned advocate appearing for the petitioner submits that upon completion of investigation, charge-sheet has already been filed in the month of November 2018. The petitioner is in custody for more than 2 years 3 months and in such circumstances further detention of the petitioner is not necessary.

The learned advocate appearing for the State opposes the prayer for bail.

Having heard the learned advocates and considering the materials on record, the gravity of the offence, we are not inclined to grant bail to the petitioner. Accordingly, the application for bail stands rejected.

It has been informed that out of 11 witnesses, examination of chief of 5 witnesses is completed and the next date is fixed on 20.01.2021.

The learned court below is requested to make all endeavour towards speedy progress of the trial. The application for bail being CRM 231 of 2021 is, thus, disposed of.
