1. The appellant is not represented before this Court on second day today.

2. It appears from the records that the appeal was dismissed for default on two earlier occasions.

3. In view of the aforesaid facts, the instant appeal being F.A. No. 40 of 2010 shall stand dismissed for default.

4. The respondent no.1 shall be entitled to apply before the learned Registrar General of this Court for refund of the money deposited in terms of the order dated 5th January, 2010, together with accrued interest within a period of ten days from date.

5. Upon receipt of the said application, the learned Registrar General of this Court shall release the amount to the respondent no.1 into the Bank Account of the said Company.

6. For the aforesaid purpose, the particulars of the Bank Account shall be furnished to the learned Registrar General of this Court in the application of the respondent no.1.

7. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
