Mr. Kamal Mishra ... for Purba Medinipur Council The petitioner has filed the instant writ application praying for a direction upon the respondents to incorporate her name in the Pension Payment Order by deleting the name of Dipali Rani Paik who happens to be the second wife of the deceased teacher.

The petitioner claims that she is the first legally married wife of the deceased teacher and she is entitled to the benefits on the death of her husband. After filing of the writ petition the District Inspector of Schools (Primary Education), Purba Medinipur has given an intimation to the petitioner by Memo No. 20/P dated 18th February, 2022 whereby she has been requested to submit certain documents in respect of her claim.

As it appears from the said communication that the respondent District Inspector of Schools (Primary

Education), Purba Medinipur is taking steps to consider the prayer of the petitioner, accordingly no useful purpose will be served by keeping the writ petition pending.

The petitioner will be at liberty to take steps pursuant to the communication dated 18th February, 2022.

The District Inspector of Schools (P.E.), Purba Medinipur shall take a decision in the matter in accordance with law at the earliest.

The writ petition stands disposed of.

The Memo dated 18th February, 2022 be retained with the records.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
