Mr. Dhiman Ray Mr. Dip Chanda ....for the petitioner Mr. Debashis Sur ....for the State Mr. Satyajit Talukder Mr. Arindom Chatterjee ....for the KMDA The petitioner claims to be the lawful owner in respect of two plots of land being R.S. Dag No.2647 and 3775 by virtue of inheritance.

The petitioner alleges that the property has been wrongly recorded in the name of the KMDA. The petitioner has approached this Court by praying for issuance of a writ of mandamus restraining the respondent authorities from encroaching upon the land of the petitioner. Mr. Talukder, learned advocate appears for the KMDA and submits that the R.S. Dag No.2647 within Mouza-Kasba was fully acquired vide Gazette Notification No.8282 LA(PW)/1M-78/82 dated November 21, 1983 and R.S. Dag No.3775 of the same mouza was also acquired in full vide Gazette Notification No.21901-L.A.(P.W.)/2R-15774 dated October 17, 1974.

The Gazette Notification has also been filed by Mr. Talukder, learned advocate for the KMDA, which is taken on record.

Though the aforesaid plots were acquired in the year 1974 and 1983, the petitioner has approached this Court only in month of January, 2026.

The petitioner has also not challenged the acquisition proceeding though it appears that the notifications were published in the Official Gazette long back.

The inordinate delay in approaching the writ court has not also been explained by the petitioner in this writ petition.

For all the aforesaid reasons this Court is not inclined to grant any relief to the petitioner. Accordingly, WPA 565 of 2026 stands dismissed. There will be no order as to costs.
