Learned advocate appearing for the petitioner submits that the petitioner is in custody for 48 days and the investigation of the case is in progress.

Learned advocate for the State has drawn the attention of the Court to the statement of the relevant witnesses. I find that the case has been registered under Sections 85/107 of the BNS. The locus of the present petitioner as is revealed from the evidence of different witnesses are that petitioner he had an extramarital affair with the deceased, for which the deceased was subjected to torture by the inmates of the matrimonial home. Having considered the locus of the present petitioner with regard to the merits of the case, I am inclined to release the

petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed.

As such, petitioner namely, Pintu Halder shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional Chief Judicial Magistrate, Tehatta, Nadia. If on bail, the petitioner shall be physically present on each and every date before the learned Court and shall not leave the jurisdiction of district of Nadia without the prior permission of the learned Court.

Accordingly, the application for bail being CRM (M) No. 172 of 2026 is allowed.
