Kausik (Rejected) CRM (M) 141 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Sonamukhi Police Station Case No. 285 of 2025 dated 12.08.2025 under section 126(2)/103(1)/61(2) of the BNS, 2023 read with section 25/27 of the Arms Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 107 days and there are no evidence so far as the present petitioner is concerned and only accusations so far as the present petitioner is that he has helped the accused to flee away with his own vehicle. Learned advocate for the State submits that the principal accused has been very recently arrested and only the first charge sheet has been filed. The fact of the case reflects that the deceased was fired which included other accused persons.

It has been submitted that some more accused persons are still absconding. There was communication between the principal accused and the present petitioner. Having regard to the materials which are appearing, prima facie, I am of the view that the allegations of conspiracy cannot be ruled out at this stage.

Accordingly, the prayer for bail of the petitioner in CRM(M) 141 of 2026 is rejected.
