Learned counsel for the petitioner contends that the CESC Limited has not yet given electricity connection to the petitioner, despite the petitioner's application for new connection.

Learned counsel for the CESC Limited, by placing reliance on a written instruction indicating that the CESC Limited has had an inspection at the premises, submits that such inspection was carried out peacefully and there is no difficulty on the part of the CESC Limited to give such connection to the petitioner.

Since the CESC Limited does not submit that any further obstruction was offered to the CESC personnel while having the inspection, there cannot be any further impediment in the matter.

Accordingly, WPA 457 of 2023 is allowed, thereby directing the CESC Limited to give new electricity connection to the petitioner at the existing meter board location, subject to the compliance of all formalities by the petitioner within a week from the date of such compliance and/or this order, whichever is later. In the event any obstruction is faced by the CESC personnel while doing so, it will be open to the CESC officials to approach respondent no.3, the Officer-inCharge of the Beliaghata Police Station, for police assistance.

If so approached, the respondent no.3 shall act on a server copy of this order and grant such assistance to the CESC personnel at the cost of the petitioner. The report filed by learned counsel appearing for the CESC Limited be kept on record.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
