The petitioner alleges that his passport had expired, pursuant thereto he had applied for a renewal thereof. However, the renewal of the passport has not been done by the concerned authority since 2024.

The petitioner states that the petitioner requires a passport to visit his daughter, who is studying in United States of America. The reason for rejection of renewal of the passport, it appears is the pendency of a criminal case against the petitioner before the Additional Chief Judicial Magistrate, Alipore.

Mr. Tewari, learned Senior Counsel appearing for the respondents submits that the authorities have no difficulty in issuing the passport, subject to the petitioner getting a prior permission from the concerned Court, in compliance

of Notification No.G.S.R. 570 (E) dated August 25, 1993, published by the Ministry of External Affairs. 4.

The petitioner is, thus, granted liberty to approach the Additional Chief Judicial Magistrate, Alipore to seek appropriate permission and to then place the same before the passport authorities for obtaining renewal of the passport.

With the aforestated direction, the writ petition is disposed of.

6. There shall be no order as to costs.

Since affidavits have not been called for, allegations contained in the petition are deemed to have been denied.
