Petitioner contends there was a fight between the parties. Allegation of miscarriage due to assault is incorrect. She prays for anticipatory bail.

Learned Advocate for the State opposes the prayer for anticipatory bail. He contends petitioner's daughter had an affair with the husband of the victim. Petitioner along with her daughter assaulted the victim and her mother-in-law. As a result, victim suffered miscarriage.

We have considered the materials on record. Injury reports do not disclose any external injury. Medical report with regard to abortion does not show any injury or signs of abortion due to assault.

Under such circumstances, we are inclined to grant anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest, the petitioner Sehnara Bibi @ Adlosi Bibi be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like Signed By : ALOK SETH High Court of Calcutta 14 th of January 2025 12:03:59 PM

amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the BNSS. She shall appear before the jurisdictional court and pray for regular bail within four weeks from date. 6.
