The petitioner is working as a "Peon" at the West Bengal College Service Commission. He is also discharging certain duties of an LDC. He made representation before the appointing authority on 23.12.2024 for promotion from Group D to LDA.

Learned counsel appearing on behalf of the College Service Commission submits that, without admitting anything contained in the writ petition, as

the representation of the petitioner is pending the same would be decided in accordance with law and in terms of the applicable Rules.

The State Government is represented.

In view of the fact that the representation of the petitioner dated 23.12.2024 seeking promotion is pending before the respondent Commission, let the respondent No. 6 consider the said representation in accordance with law and upon hearing the interested parties as expeditiously as possible, preferably within eight weeks from the date of communication of this order. If the representation is considered favourably the same shall be forwarded to the DPI for appropriate action in accordance with law.

It is clarified that as affidavits have not been called for, the allegations made shall be deemed not to have been admitted.

It is further made clear that the merits of the case have not been gone into.

Urgent Photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
