The petitioners are aggrieved by the fact that in spite of petitioners having approached the civil court and necessary directions passed in Title Suit No. 36/2024, the petitioners are subjected to threat, criminal force and coercion.

Presently, the said land/property has been occupied by the Public Health Engineering Department at the behest of the private respondents. Be that as it may, however, the civil court is already in seisin of the issue relating to cultivation, usage, ownership etc. of the said land. Having regard to the fact that there may be certain disputes and differences between the petitioners

and the private respondents and in view of the fact that the police authorities have already drawn up proceedings under Sections 126/135(3) of BNSS, 2023, it is directed that the police authorities would continue to keep a strict vigil and ensure that no breach of the peace and tranquility takes place and/or any untoward incident results because of the inimical relationship existing between the petitioners and the private respondents.

With the aforesaid observations, the writ petition being WPA 569 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
