1. Affidavit-of-service filed in Court today be kept on record.

2. Since none appeared for either of the parties at the time of dismissal for default, the principle of Order IX Rule 4 of the Code of Civil Procedure is applicable and no further notice is required to be given to the respondents.

3. In view of sufficient reasons being disclosed in the application for the absence of the petitioner on the relevant date, CAN 1 of 2022 is allowed, thereby recalling the order dated November 11, 2022 passed in WPA No. 522 of 2021 and restoring the said writ petition to its original file and number.

4. There will be no order as to costs.

5. The writ petition shall next be listed in the monthly combined list of cases for the month of May, 2024.
