By this public interest petition the petitioner has sought cancellation of notice inviting tender dated 25.11.2021 and consequential work order dated 21.12.2021.

The petitioner is running a Private Contractor Trade in the name and style "M/s. Biswas Enterprise" as a sole proprietor and the allegation of the petitioner is that the tendering authority had illegally charged a free for development and that the bid was not open on the scheduled date.

Para 10 of the petition reveals that the petitioner wanted to participate in the tender process, but could not do so.

Hence, we are of the opinion that in the guise of the public interest litigation the petitioner is raising the

personal cause, which cannot be permitted. Hence, petition is dismissed.
