Matter relates to transfer of the petitioner based on application made on Utsashree portal on 15th April, 2022. It is submitted by the learned advocate representing the petitioner that spouse of the petitioner is suffering from ailments which prompted him to make application seeking transfer on the portal. It appears from a document at Page 17 of the writ petition that transfer application of the petitioner was forwarded by the school authority on 27th April, 2022 to the concerned District Inspector of Schools (S.E.) for taking further steps. District Inspector of Schools (S.E.), Jhargram in his turn has completed formalities and forwarded the transfer application of the petitioner to the West Bengal Central School Service Commission on 31st May, 2022 for taking final decision. Grievance of the petitioner is in spite of receipt of transfer application far back on 31st

May, 2022, till date no decision has been taken by the Commission.

Respondents are represented by learned advocates who have submitted that due to suspension of portal contemporaneous decision could not be taken on transfer application of the petitioner.

However, it is submitted on behalf of West Bengal Central School Service Commission that if concerned authority is directed decision shall be taken in accordance with law on transfer application of the petitioner.

Having considered the submissions made on behalf of the parties, writ petition stands disposed of directing the Chairman, West Bengal Central School Service Commission being respondent no.3 to decide transfer application of the petitioner by eight (8) weeks from the date of communication of this order and the decision to be communicated to the petitioner by one (1) week thereafter.

It is made clear that suspension of portal shall not be a ground to reject transfer application of the petitioner.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
