Learned advocate appearing for the petitioner submits that the petitioner is in custody for six months. Learned advocate for the State submits that she is an Indian National and her fore-fathers are also permanent resident of India. The petitioner's name is appearing in the electoral role. Further citizenship certificate is also available. State relies upon the document which was seized at the time of appreciation of the present petitioner which reflects that the petitioner in 2013 entered India with tourist VISA. The petitioner was intercepted at the Petropole border. Having regard to the factual scenario under which the Police authorities registered the case particularly the seizure made by the Immigration Officer which reflects not only Indian documents is in possession of the present petitioner but also documents of citizenship of Bangladesh, I am of the view that at this stage, the prayer for release of the petitioner cannot be granted.

Accordingly, CRM (M) 112 of 2026 is dismissed.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent Photostat certified copy of the order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
