Case No. 206 of 2020 dated 01/10/2020 under Sections 341/195A/506 of the Indian Penal Code, 1860.

And In the matter of: Sri Biswajit Biswas ....petitioner.

Ms. Sananda Bhattacharyya ...for the petitioner.

Mr. Sudip Ghosh Mr. Bitasok Banerjee ...for the State.

Petitioner seeks anticipatory bail.

Learned Advocate appearing for the petitioner submits that number of proceedings were initiated with regard to matrimonial disputes between the petitioner and the de facto complainant. The present police complaint is one of the same. Other co-accused were granted anticipatory bail in the present police complaint.

Learned Advocate appearing for the State draws the attention of the Court to the contents in the case diary. He submits that the police submitted charge sheet. Considering the fact that the police concluded the investigation and submitted charge sheet, we are of the view that the custodial interrogation of the petitioner is not required. Consequently, we grant anticipatory bail to the petitioner. Accordingly, we direct that in the event of arrest, the

petitioner shall be released on bail upon furnishing a Bond of Rs.10,000/- with two sureties of like amount each to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioner shall appear before the jurisdictional Court on the dates fixed for trial and pray for regular bail within four weeks from date.

The application for anticipatory bail being C.R.M.(A) 130 of 2022 is, thus, disposed of.
