The grievance of the petitioner is that the West Bengal State Electricity Distribution Company Limited (in short 'WBSEDCL') has taken a high-tension electric connection over the property of the petitioner, thereby causing risk and jeopardy to the petitioner. Learned counsel appearing for the WBSEDCL, in his usual fairness, reiterates the stand taken by the WBSEDCL that the WBSEDCL is agreeable to shift the high-tension electric line, subject to availability of an alternative route and compliance of all formalities by the petitioner, including filing the proper application and payment of all necessary expenditure in that regard.

In view of such fair stand having been taken by the WBSEDCL, WPA No. 430 of 2022 is disposed

of by granting liberty to the petitioner to file an application in appropriate format before the WBSEDCL for shifting of the high-tension electric line-in-question.

Upon such application being received, the WBSEDCL will cause necessary enquiry/inspection and intimate the petitioner as regards the amount assessed as shifting charges. The petitioner shall comply with all formalities including payment of such charges as assessed by the WBSEDCL (of course, without prejudice to the right of the petitioner to challenge such quantum, if the petitioner is aggrieved thereby, before an appropriate authority).

In the event such an application is made and all the formalities are complied with by the petitioner, the WBSEDCL shall endeavour to shift the hightension electric line as expeditiously thereafter as possible, preferably within six weeks from the date of compliance of all formalities by the petitioner. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
