The petitioners complain of illegal and unauthorized construction.

The petitioners allege that the legal representation filed on their behalf has not been disposed of by the Katwa Municipality till date. On a perusal of the representation filed on behalf the petitioners it appears that, details of the unauthorized construction are not clearly mentioned. In view of the above, the instant writ petition is disposed of by granting liberty to the petitioners to file fresh representation highlighting the details of the alleged unauthorized construction.

In the event such a representation is made, the Board of Councillors, Katwa Municipality shall take into consideration and dispose of the same in accordance with law after giving a reasonable opportunity of hearing to all the necessary parties.

The Municipality shall endeavour to dispose of the representation to be filed by the petitioners at the earliest, but positively within a period of twelve weeks from the date of receipt of the same.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
