Petitioner contends de-facto complainant-wife had left the matrimonial home in 2020. After four years, criminal case has been registered. Accordingly, petitioner prays for anticipatory bail.

Learned Advocate for the State opposes the prayer for anticipatory bail.

We have considered the materials on record. Allegations of cruelty are general and omnibus. It is contended de-facto complainant-wife left the matrimonial home in 2020. 4.
Under such circumstances, we are inclined to grant anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest, the petitioner viz., Biplab Kumar Jha be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the Arresting Officer and also Signed By : ALOK SETH High Court of Calcutta 14 th of January 2025 12:03:59 PM
subject to the conditions as laid down under Section 482(2) of the BNSS. He shall appear before the jurisdictional court and pray for regular bail within four weeks from date. 6.
