Learned advocate appearing for the petitioners submits that the petitioners have been implicated in connection with the instant case for alleged recovery of 8 kgs. of ganja and 297 bottles of phensydl. Petitioners earlier approached this Court when the liberty was granted to renew the prayer for bail after the charges have been framed.
Records reflect that charge has been framed on 24.12.2025.
Learned advocate for the State opposes the prayer for bail on the ground that the petitioners' anticipatory bail were rejected and they are not similarly situated as other accused persons who have been granted bail.
Having considered the period of the detention of the present petitioners, i.e. for four months, I am of the view that further detention of the petitioners is unwarranted. Accordingly, the prayer for bail of the petitioners is allowed. The petitioner no.1, namely, Imajuddin Sk @ Imajuddin Sekh @ Feru and the petitioner no.2, namely, Ayub Sk @ Ayub Mondal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned Additional District Judge, 5th Court, Berhampore, Murshidabad. If on bail, the petitioners shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of Murshidabad without the prior permission of the learned special court.
Accordingly, CRM (NDPS) 77 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
