Petitioner is aggrieved that she is not receiving police assistance for restoration of water and electricity connection in spite of directions passed by the Civil Court.

State has submitted a report which reflects that in T.S. 31/2016 by an order dated 30.08.2023 the Civil Court has refused to render any police assistance for restoration of electricity connection and the said application filed by the petitioner was dismissed. In view of the Civil Court already in seisin of the issues relating to electricity and water connection, this Court under Article 226 of the Constitution of India will not direct the police authorities.

However, petitioner would be at liberty to approach the statutory appellate Court or Revisional Court for remedies available under the law.

Since the subject matter relates to essential supplies the concerned authorities would consider the same, if an appropriate application is filed under the relevant provision before the authorities.

With the aforesaid observations WPA 439 of 2024 is disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
