.... For the Petitioner Mr. Ratul Biswas .... For the Board The petitioner seeks appointment as a primary school teacher. She participated in the TET, 2014 examination and qualified the same. She, however, could not apply for recruitment pursuant to the notification issued by the West Bengal Board of Primary Education (hereinafter referred to as the Board) on 23rd December, 2020 as she did not have the training qualification. The recruitment notice of the Board clearly mentions that appointment will be given from the candidates who are trained. The essential qualification for being eligible for applying for the post of primary school teacher was a training qualification as prescribed by the National Council for Teacher Education and should have qualified in TET, 2014.

The petitioner is an untrained candidate. She is aggrieved by the notification for recruitment dated 23rd December, 2020, wherein training has been included as

the minimum eligibility criteria for being eligible for recruitment as primary school teacher.

The petitioner has approached this Court at a very delayed date. The process of recruitment pursuant to the impugned notification dated 23rd December, 2020 is already over. Had the petitioner been aggrieved by the eligibility criteria mentioned in the aforesaid notification she ought to have approached Court immediately thereafter.

No relief can be granted to the petitioner in the instant case.

The writ petition fails and is hereby dismissed. Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking. (Amrita Sinha, J.)
